1. Who you are contracting with
These terms form an agreement between you and Yolande Mostert, trading as PSI-G Placement Services International South Africa (“PSI-G”, “we”, “us”), based in Bethlehem, Free State, South Africa. Contact us at yolande@psiplacements.co.za or on +27 72 273 9471.
2. Our service
We provide visa application assistance, document support and placement facilitation for South African applicants seeking seasonal or temporary work in the United States (H2A, H4 and B1/B2 applications), and related administrative services to employers. We are a private agency, not a government body, and we cannot guarantee that any visa will be issued.
3. Acceptance and authority
By creating an account, submitting an application or paying our fees you accept these terms. If you accept on behalf of a business you confirm you have authority to bind it; if you accept as an individual you confirm you are of legal age.
4. Your obligations
You must provide accurate, complete and current information and supporting documents, and update them when they change. You are responsible for keeping your account credentials confidential and for all activity under your account.
5. Acceptable use
You must not use the service for any unlawful purpose, and specifically must not:
- submit fraudulent, forged or misleading documents or information;
- send spam, or attempt fraud or impersonation of any person or employer;
- infringe the intellectual property or privacy rights of others;
- interfere with the security of the service, including introducing malware, probing, penetration testing, scraping or circumventing technical limits;
- reverse engineer, resell or redistribute the service.
6. Intellectual property
We retain all ownership of the website, software, documentation, templates and branding. You receive a limited, non-exclusive, non-transferable right to use the service for your own application or placement. You grant us a limited licence to host and process the content and documents you upload, solely to provide the service.
7. Service availability
We aim to keep the service available, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim implied warranties, including merchantability and fitness for a particular purpose.
8. Payments and billing
Fees are shown before checkout and are charged as one-off amounts (for example agency and administration fees per applicant, and invoices issued to employers). Payment, billing, tax, cancellation and refund mechanics are governed by Paddle’s Buyer Terms. See also our Refund Policy.
9. Reseller / Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
10. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination you may request a copy of your submitted data within 30 days, after which we may delete it subject to our retention obligations.
11. Liability
To the extent permitted by law, our aggregate liability is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill, or for decisions made by United States consular authorities or employers. Nothing excludes liability for fraud, death or personal injury where the law does not allow it.
12. Indemnity
You indemnify us against claims arising from content or documents you supply, your unlawful use of the service, or your breach of these terms.
13. General
These terms are governed by the laws of South Africa and disputes fall to the courts of South Africa. You may not assign your rights without our consent; we may assign in connection with a merger or sale. Neither party is liable for delays caused by events beyond reasonable control. We may update these terms and will post the revised version on this page.
